1. Purpose
These terms govern theweb hosting,email hosting and domain name management services provided by InfoXtreme inc. They are in addition to the Terms of use and the Privacy policy, which continue to apply. In the event of a discrepancy on a point specific to hosting or domain names, these terms prevail.

2. Plans and what they include
Each plan is defined by specific limits, enforced on our servers. They are as follows:

Unlimited bandwidth means normal use for a business website. InfoXtreme may contact a client whose usage affects the operation of the shared server, in order to agree on a solution.
3. Space used and overage
The space used includes the site files, databases, mailboxes and logs. InfoXtreme monitors the space used and contacts the client when they approach the limit of their plan, so that they can clean up or move to a higher plan.
Prolonged overage may result in a move to the plan matching actual usage, after agreement with the client. InfoXtreme does not interrupt a live site without notice for this reason.
4. Backups
InfoXtreme performs a daily backup of the hosting server, for recovery purposes in the event of a disaster affecting the server.
This backup is not a backup service for the client’s site. It covers the server, its retention period is not guaranteed, and it does not replace a copy that the client would keep themselves. The client remains responsible for keeping their own copy of their site, databases and emails. InfoXtreme also offers separate backup services, which are covered by a separate agreement.
5. Availability
InfoXtreme uses reasonable means to keep the services accessible at all times, without being able to guarantee constant availability. Interruptions may occur for maintenance, security updates, or due to causes beyond our control. Planned interruptions are announced in advance whenever possible.
6. Domain names
- Ownership. The domain name belongs to the client. InfoXtreme acts as an intermediary with the registrar and registers it in the client’s name.
- Renewal. Domain names are renewed automatically, unless the client gives written notice to the contrary at least 30 days before the due date. Renewal is billed at the rate in effect at the time of renewal.
- Term. A domain name may be registered or renewed for a term of 1 to 5 years, at the price of the chosen term.
- Expiry. A domain name that is not renewed stops working on its expiry date. The delays and fees for recovery after expiry are those set by the registrar, and do not depend on InfoXtreme.
- Transfer. The client may transfer their domain name to another provider at any time, provided their account is in good standing. InfoXtreme provides the authorization code upon written request.
7. Prices and billing
- Prices are shown in Canadian dollars and are before GST and QST.
- Hosting plans are billed in advance, for the coming period. Domain names are billed in advance for the chosen term.
- The invoice is sent before the due date and is payable within 30 days of its issue.
- A plan change during the term results in an adjustment calculated pro rata for the days remaining before renewal.
- InfoXtreme may change its prices. Any increase is communicated at least 60 days before it applies, and only takes effect at the next renewal of the service concerned. A client who refuses an increase may terminate the service at its due date, without penalty.
8. Late payment
If payment is not received within 30 days of the due date, InfoXtreme may, after written notice of at least 10 days, suspend the services concerned. Suspension makes the site and emails inaccessible, without erasing the data. Services are restored as soon as the balance is paid.
9. Termination and what happens to the data
- The client may terminate a service at any time, in writing. Termination takes effect at the end of the period already paid; amounts paid for that period are not refunded.
- InfoXtreme may terminate a service with written notice of 60 days, or immediately in the event of use contrary to section 10.
- Upon termination, the client may request a copy of their data. InfoXtreme provides it within a reasonable time, in a common format.
- Data is kept for 30 days after the end of the service, then permanently deleted. After that period, it can no longer be recovered.
10. Acceptable use
The client agrees not to use the services to: distribute illegal content or content that infringes the rights of third parties; send unsolicited bulk email; host malware or phishing pages; attempt to access other people’s data; or consume resources in a way that harms other clients on the shared server.
The client is responsible for keeping the applications they install and the passwords they choose up to date. A compromised site may be suspended without notice while it is cleaned up, in order to protect other clients.
11. Personal information
The handling of personal information is described in InfoXtreme’s Privacy policy . When the client hosts with us personal information about their own clients or employees, they remain responsible for it within the meaning of the law. InfoXtreme then acts as a service provider and uses it only to deliver the service.
12. Changes to these terms
InfoXtreme may change these terms. Any significant change is communicated to the client by email at least 30 days before it takes effect, and the update date is shown at the top of the page.
13. Governing law
These terms are governed by the laws applicable in the Province of Québec. Any dispute falls under the courts of the judicial district of Joliette.
