TERMS OF USE

This agreement sets out the terms and conditions between “InfoXtreme Inc.” and you (the “client”). By accessing the website www.info-xtreme.com (the “site”) or purchasing services through the site, the client agrees to comply with InfoXtreme inc.’s privacy policy and with these terms and conditions (collectively, the “agreement”). This agreement supersedes all prior agreements, whether oral or written, between InfoXtreme inc. and the client. Please read this agreement carefully before browsing our website or using our services.
1. Our services
InfoXtreme Inc. offers services in the field of information technology, including web development, computer sales and repair, networking, web hosting, cybersecurity and telephony (collectively, the “services”). InfoXtreme Inc. cannot guarantee the constant availability of the services on its site but will make every effort to provide them whenever possible.
2. Additional agreement
If the client requires services other than those covered by this agreement, these additional services must be the subject of a separate contract. To do so, the client must contact InfoXtreme Inc. by email at yannick@info-xtreme.com.
3. Ownership and confidentiality of documents
The client affirms the right to provide all documents used in the course of the service and confirms that their use by InfoXtreme inc. at the client’s request complies with the law and does not infringe the intellectual property or other rights of third parties.
All documents submitted by the client will be treated confidentially. Any personal information collected by InfoXtreme Inc. from the client will be handled in accordance with InfoXtreme Inc.’s privacy policy.
4. Disputes
Any comment or complaint regarding the accuracy of a translation, revision or writing, or the quality of a service under this agreement, must be submitted in writing to InfoXtreme inc. by the client within fifteen (15) days following delivery of the service. This request must be made by email, using the client’s email account registered with InfoXtreme inc. No other method of communication (including telephone or postal mail) will be accepted for submitting comments or complaints.
5. Use of the site
The site is intended for use only by persons who have reached the legal age or the age of majority in their jurisdiction and who are capable of entering into legally binding contracts under applicable law. The site must not be accessed or used by anyone in territories where such access or use may be illegal or prohibited. The client is solely responsible for the legality of their use of the site and must comply with all applicable laws.
6. Force majeure
To the extent permitted by applicable law, InfoXtreme Inc. shall not be liable if the performance of an obligation under this agreement becomes impossible or commercially unreasonable due to a cause or event beyond its control, including force majeure (as defined in article 1470 of the Civil Code of Québec), natural disasters, government acts, actions of clients, terrorism, war, civil unrest, work stoppages or strikes, fires, explosions, etc.
7. Intellectual property rights
The site, including its content, texts, graphics, scripts, layout and other information contained in the texts, graphics, audio and video clips, software, drawings, applications, data and other elements accessible on or through the site, as well as the way in which the content is presented or appears, remains the property of InfoXtreme Inc. It is protected by copyright, trademark and other intellectual property laws. Use of the site does not confer on the client any ownership or other right in the site or its content.
8. Permitted use
The site is provided for the client’s lawful use only. In particular, unless expressly authorized in this agreement, the client agrees, as a condition of using the site, not to use the site for purposes that are unlawful under applicable law or prohibited by this agreement; not to copy, imitate, reproduce, republish, download, post, transmit, modify, index, catalogue, reverse engineer, decompile, display, revise, interpret, transfer or distribute the site or its content, or license or sublicense it, in whole or in part (including the software used in the operation of the site), without prior written consent.
9. Governing law
This agreement, the client’s access to and use of the site and all related matters are governed by the laws of the Province of Québec and the applicable federal laws of Canada. Any dispute between the client and InfoXtreme inc. or any other person, arising from or related to the site, this agreement or any related matter, must be brought before the courts of Québec.
10. Severability
If any provision of this agreement is found to be invalid or unenforceable for any reason, it shall be deemed severable from the remainder, and the other provisions shall remain valid and enforceable.
11. Binding effect
This agreement binds InfoXtreme inc., its successors, assigns and related persons, as well as the client and their heirs, executors, administrators, successors, permitted assigns and representatives. The client may not assign the obligations and rights conferred by this contract. InfoXtreme inc. may assign this agreement and its rights and obligations without the client’s consent.
